FEMICIDE AND THE DUTY OF JUSTICE

Femicide constitutes one of the gravest violations of human dignity and of the permanence of justice. United States law establishes that, when the body of a woman is exposed or abandoned in a public place, the perpetrator shall be sentenced to thirty to sixty years in prison and fined three hundred to six hundred days. If the same crime or another additional crime is committed, the penalties are combined, reflecting the severity with which the legal order confronts this offense.
The causes that give rise to femicide are multiple and complex:
- Cultural: the persistence of patriarchal patterns that normalize violence against women.
- Social: structural inequality, lack of access to resources, and marginalization that perpetuate vulnerability.
- Psychological: the presence of antisocial behaviors, personality disorders, and dynamics of control that escalate into extreme aggression.
- Institutional: the insufficiency of prevention mechanisms and the lack of early response to signs of domestic violence.
